Terms of Service

These Terms govern your use of predictiongenius.io (the “Service”). Use the Service and you agree to them. If you do not, do not use it.

1. What the Service is

Prediction Genius aggregates public prediction market data from third-party exchanges (Kalshi, Polymarket, PredictIt) and adds editorial analysis. We are a data and information service. We are not an exchange, a broker, a financial advisor, or a gambling operator. Trades happen on the underlying exchanges, not here.

2. This is not financial or betting advice

Everything on Prediction Genius is for information and education only. It is not financial advice, investment advice, trading advice, betting advice, or a solicitation to participate in prediction markets, gambling, or any financial activity. Prediction markets can lose you money. Past performance does not predict future results. Any decision you make off our information is yours alone. Talk to a qualified professional before you act on it.

3. Who can use it

You must be at least 18 and able to form a binding contract. Whether prediction markets, gambling, or related activity are legal where you are is on you. We do not warrant that the Service or its content is legal or available in your jurisdiction.

4. Acceptable use

Do not:

• Use the Service for anything unlawful or against these Terms
• Scrape, mirror, or bulk-download the Service's content
• Reverse-engineer, decompile, or try to pull source code
• Interfere with or disrupt the Service or its infrastructure
• Misrepresent where the data came from or how accurate it is when you redistribute it
• Use the Service to harass, harm, or defraud anyone

5. Intellectual property

The Service, including its design, code, editorial content, and the Prediction Genius brand, belongs to Prediction Genius Inc. and is protected by IP law. The underlying market price data belongs to the exchanges (Kalshi, Polymarket, PredictIt); we aggregate and present it under fair-use principles. Link to us and quote us with attribution. Do not republish large chunks of our editorial without permission.

6. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will be accurate or complete. Market data is aggregated from third-party sources and may have errors, delays, or gaps.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREDICTION GENIUS INC., ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify and hold harmless Prediction Genius Inc. from claims arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Termination

We can suspend or end your access at any time for violations, abuse, or illegal activity. You can stop using the Service whenever you want. The sections that should outlive termination by their nature (intellectual property, disclaimers, limitation of liability, dispute resolution) survive.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes go to the state or federal courts in Delaware, except where the law says otherwise.

11. Changes to these Terms

We update these when we need to. Material changes get posted here with a new “Last updated” date and, where it makes sense, an email. Keep using the Service after a change and you accept it.
